Lovespoken respects the intellectual property rights of others and expects the same of anyone using our Services — including anyone who uploads their own song for an RSVP page. This page explains how to submit a copyright infringement notice under the Digital Millennium Copyright Act (DMCA), and how to respond if your own content was removed.

Filing a DMCA takedown notice

If you believe content available through Lovespoken infringes your copyright, you (or your authorized agent) may send a written notice to our designated agent below. To be effective, your notice must include:

  • A physical or electronic signature of the copyright owner or someone authorized to act on their behalf.
  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material you claim is infringing, and information reasonably sufficient to let us locate it (e.g. the RSVP page link).
  • Your name, address, telephone number, and email address.
  • A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on their behalf.

Counter-notification

If content you uploaded was removed and you believe this was a mistake or misidentification, you may submit a counter-notification to our designated agent above. Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed and where it appeared before removal.
  • A statement, made under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., New York), and that you will accept service of process from the party who filed the original notice.

Repeat infringers

Consistent with the DMCA and our Terms & Conditions, Lovespoken may remove content in response to a valid notice and may terminate access to features like custom song uploads for accounts with repeated infringing uploads.
